The Fuegian Justice Department asks the Municipality of Tolhuin to reformulate the complaint against Leolabs for the radar.

This is because the municipality proposed, in the same case, imposing a fine for successive non-compliance and taking executive action for the dismantling of the radar and the demolition of its bases.

The Tolhuin Comprehensive Jurisdiction Court, headed by Dr. José Silvio Pellegrino , requested the municipality of Tolhuin to adjust the claims regarding the actions carried out against the company LEOLABS ARGENTINA SRL .

In legal terms , proposed imposing a fine for repeated violations of municipal regulations, and, on the other hand, taking executive action to dismantle the antenna field and demolish its bases. Judicial sources informed Agenda Malvinas this morning, after the court's own response was made public.

The concrete fact is that last Wednesday the 9th, the municipality of Tolhuin, in a conference headed by Mayor Daniel Harrigton , held at the headquarters of the Malvinas Argentinas War Veterans Center in Río Grande , and together with the president of the VGM institution Luis Cepeda and the mayor of this city Martín Pérez ; reported that it had initiated a fiscal execution trial for the dismantling of said structure. Measure that was promoted after the reconsideration appeal filed by the company LEOLABS ARGENTINA SRL was rejected. Contemplating not only its dismantling, but also the payment of the corresponding fine for non-compliance with municipal ordinances.

At that press conference, Tolhuin Mayor Daniel Harrington stated that the LEOLABS tax enforcement action was based on the company's debt for non-payment of a fine of 868,000 pesos (plus interest), imposed in 2023 for an infraction related to the civil works at the El Relincho ranch. He announced an additional measure as an executive decision, which materialized when he also requested the courts to approve the dismantling of the radar and the demolition of its supporting structure. The Municipality of Río Grande ratified its support, acting as an amicus curiae.

The information published by Radio Fueguina at 8:05 a.m. this Monday, April 14 , indicates that Judge Silvio Pellegrino "rejected the lawsuit filed by the Municipality of Tolhuin against the company Leolabs Argentina SRL, considering that the two procedural objects raised are not compatible within the same legal action. As a result, the proceedings were returned for a reconsideration of their presentation."

The company's appeal for reconsideration was rejected by the Municipality on March 31, and notification was sent on April 1. After receiving no response, the authorities considered the deadline expired and proceeded with legal action, according to the Rio Grande newspaper.

The legal filing was supported by the municipality of Río Grande, the city's War Veterans Center, the National Confederation of War Veterans, and the Malvinas War Veterans Center in Ushuaia , all of whom supported the claim made by the Tolhuín government. The municipality must now clarify its demands if it wishes to continue with the process.
