Ten days after the CECIM's formal demand, Milei ratifies by omission the handover of the Malvina Islands to Great Britain

He ignored the formal letter from the veterans demanding a retraction of his statements to The Telegraph within 24 hours. The expiration of the legal deadlines leaves the president on the verge of criminal charges for dereliction of duty and opens the door to impeachment proceedings.

The legal action against Javier Milei is imminent and would target article 248 of the Penal Code: Abuse of Authority and Violation of the Duties of Public Officials.

Ten days have passed since the Malvinas Islands Ex-Combatants Center (CECIM) La Plata sent a scathing formal letter to President Javier Milei . The ultimatum was clear: 24 hours for Milei to retract his statement subordinating Argentine sovereignty to the "wishes" of the colony established in the Malvinas . The deadline has long since passed, and the official response has been complete silence .

This silence is not neutral . In the legal sphere, refusing to respond to a legal summons regarding acts that compromise territorial integrity is interpreted as a reiteration of the reported conduct . By not retracting his statements to the British press, Milei has chosen to firmly maintain his alignment with the Foreign Office's doctrine.

The worst-case scenario: Silence as ratification

This lack of response confirms a capitulating state policy . The President cannot claim ignorance; he has been duly notified that his statements violate the First Transitory Provision of the National Constitution .

By remaining silent, Milei confirms that:

1.    It upholds the Kelper self-determination: Its concept that the islands will return "when the islanders wish" remains firm as the Executive's position.

2.    He disregards the constitutional mandate: He ignores the duty to defend Argentine sovereignty over the South Atlantic above any personal admiration for figures like Margaret Thatcher .

3.    It enables legal action: Since there is no retraction, the intentional breach of the duties of a public official is established.

Towards criminal prosecution and impeachment

The president's refusal clears the way for CECIM La Plata to file a criminal complaint in federal court. According to sources within the organization, the legal action is imminent and could directly target Article 248 of the Penal Code .

Article 248 of the Argentine Penal Code addresses Abuse of Authority and Violation of the Duties of Public Officials, penalizing officials who issue resolutions contrary to the law or execute illegal orders with prison sentences and/or disqualification from holding public office. This differs from Article 249, which penalizes the general failure to perform administrative functions. This offense requires intent and knowledge of the illegality of the act, unlike Article 249, which can encompass negligence.

But the gravity of the situation transcends the legal realm . If a nation's head of state refuses to reaffirm sovereignty over its usurped territory in the face of a demand from war veterans themselves, the situation enters a realm of extreme institutional crisis . The National Congress no longer has any excuse to postpone the debate on impeachment proceedings . Parliamentary inaction in the face of a president who remains silent in the face of this sovereignty challenge amounts to a validation of national dissolution .

A message to London

While official silence reigns in Buenos Aires, the message is clear in London and Puerto Argentino: Argentina has a government unwilling to defend its Constitution against the British Crown. Every day of silence from Milei is a day that consolidates the illegal occupation and plunder of our natural resources.

The clock of history and the clock of justice tick at different speeds, but both have begun counting down the days for an administration that has turned its back on the nation. Milei's silence is, ultimately, his admission of guilt.
