MELELLA DOESN'T KNOW HOW TO LITIGATE: THE PATHETIC LEGAL TRAIL OF THE TIERRA DEL FUEGO GOVERNMENT TO RECOVER THE PORT

Federal Judge Federico Calvete has not yet rejected the injunction on the merits of the case, but has issued a ruling that makes the province's legal team look ridiculous, calling the request "incomplete" and exposing errors that are considered basic in the legal field and, in this context, simply pathetic.

Governor Gustavo Melella's legal strategy to try to recover the Port of Ushuaia has run up against the reality of his own incompetence . Highly trusted judicial sources consulted by Agenda Malvinas confirm that Federal Judge Federico Calvete did not reject the injunction filed today by the Tierra del Fuego Executive Branch on the merits of the case; instead, he issued a ruling that makes the province's legal team look ridiculous, calling the request "incomplete" and pointing out errors that are considered basic in legal terms and, in this context, simply pathetic .

 

The head of the lawyers who cannot litigate

The most shameful detail in Calvete's ruling concerns Emiliano Fossatto, Legal Advisor and head of the province's lawyers . The judge had to order him to obtain his federal bar license, revealing that the top legal official of the Tierra del Fuego government has never litigated in federal court.

It's an institutional scandal: while the governor announces an "epic battle" for sovereignty, he sends an official to the front lines who isn't even "licensed" to enter the playing field. How is it possible that the head of the state attorneys is unaware of such a basic procedural requirement? This negligence is a true reflection of an administration that confuses political activism with professional competence.

Calvete's three slaps

Judge Calvete has requested three preliminary explanations that leave Melella in a dead end:

1.    Original jurisdiction of the Court?: Calvete has asked the Federal Prosecutor to rule on whether this conflict—a province against the National State—should not go directly to the Supreme Court of Justice . If so, the local filing was a deliberate waste of time.

2.    The State Prosecutor's silence: The judge demands to know why the State Prosecutor, the province's natural and constitutional representative, is not acting . Melella 's decision to remove the State Prosecutor and replace him with a political appointee ( Fossatto ) without federal credentials smacks of a maneuver to obscure internal legal oversight.

3.    The $60,000 Consulting Fee: Herein lies the question that outrages the public: If the government hired the Buenos Aires-based firm YMAZ SRL for $60,000 (90 million pesos), how could they allow such egregious errors as Fossatto's lack of professional registration or the State Prosecutor's omission? What exactly are they advising on for that fortune in dollars?

An "incomplete" and desperate plea

According to the experts consulted by Agenda Malvinas , the province's request is "incomplete ." Calvete hasn't even been able to begin analyzing whether the intervention is legal or not, because the Tierra del Fuego government hasn't met the essential requirements for the judge to "open the door" for them.

This accumulation of inconsistencies reveals an overwhelmed Melella and his cabinet, attempting to cover up with legal loopholes what they failed to defend through port management. While the port remains under intervention and national control, the province wastes resources and time on poorly prepared presentations that only serve to confirm the current administration's technical incompetence.

Today, the "pathetic" debacle at the Federal Court of Ushuaia is a reflection of a management that has lost its way, its port and, now, also its professional shame.

Melella is on the brink of disaster, not because of an external conspiracy, but because of the alarming mediocrity of a team that doesn't even know how to present itself to a judge.
